Terms of Service & User Agreement

Please read these Terms of Service ("Terms") carefully before using the MoatPicks.io website, web applications, or quantitative subscription services operated by Alboran Ventures OÜ ("Company", "we", "us", or "our").

1. Acceptance of Terms & Operator Identification

These Terms of Service constitute a legally binding agreement between you and Alboran Ventures OÜ, the operating legal entity of the MoatPicks.io platform.

By creating an account, accessing, browsing, or subscribing to MoatPicks.io (the "Platform"), you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must immediately discontinue use of the Platform.

2. Description of Service & Not Financial Advice (NFA)

MoatPicks.io is a quantitative financial software tool designed solely for informational, research, and educational purposes. The Platform provides automated equity screening algorithms, 12-point fundamental auditing matrices, Peter Lynch PEG valuation formulas, and SEC Form 13F filing aggregation.

CRITICAL FINANCIAL NOTICE:
MoatPicks.io is NOT a registered investment advisor (RIA), broker-dealer, financial planner, commodity trading advisor, or fiduciary under any regulatory framework (including the SEC, FINRA, FCA, or ESMA). Nothing on the Platform constitutes personalized financial advice, investment recommendations, or an endorsement to buy or sell any asset. 3. Eligibility & User Accounts

You must be at least 18 years old to create an account. When registering, you agree to provide truthful and accurate information. You are solely responsible for preserving the confidentiality of your account login credentials and for all activities occurring under your account. You agree to notify us immediately at info@moatpicks.io if you suspect unauthorized access.

4. Subscriptions, Payments & Automatic Renewal

MoatPicks offers optional premium subscription tiers ("PRO Access") with recurring billing cycles (weekly, monthly, quarterly, or annual) or one-time lifetime licenses.

Stripe Payment Processing: All payments are processed through Stripe, Inc. By subscribing, you authorize our third-party payment processor to charge your chosen payment method on a recurring basis.
Automatic Renewal: Recurring plans automatically renew at the end of each billing cycle unless cancelled prior to the renewal date.
Cancellation Policy: You may cancel your subscription at any time without penalty via your account portal or by emailing our support desk at info@moatpicks.io. Upon cancellation, your PRO features remain fully accessible until the conclusion of the active paid period.

5. Digital Goods Refund Policy (EU Compliance)

MoatPicks delivers immediate digital access to proprietary financial algorithms, deep screening models, and live market metrics.

          Digital Performance & Statutory Withdrawal:

          Pursuant to Article 16(m) of EU Directive 2011/83/EU on Consumer Rights and corresponding global digital regulations, when you purchase a subscription or digital pass and gain instant access to our proprietary software and algorithms, you expressly acknowledge and agree that performance begins immediately and you waive the standard statutory 14-day right of withdrawal.

Fair-Play Support: We value our community. If you experienced a genuine technical failure or were billed mistakenly, contact us within 7 days at info@moatpicks.io with your account email. Our support team handles exceptional requests fairly on a case-by-case basis.

6. Intellectual Property & Prohibited Conduct

All intellectual property rights in the Platform, including the Moat Score™ algorithmic methodology, database schemas, graphics, UI design, and underlying code, are owned exclusively by MoatPicks AI.

You agree NOT to:

Scrape, crawl, extract, or harvest data or Moat Scores using automated scripts, bots, spiders, or scrapers without express written authorization.
Reverse-engineer, decompile, or disassemble any part of the algorithms or backend software.
Resell, redistribute, license, or commercially syndicate our proprietary stock lists or rankings.
Interfere with the security or performance of our servers, networks, or cloud infrastructure.

7. Data Accuracy & Latency

Financial market data (such as quotes, price changes, and fundamentals) is sourced from third-party APIs including Yahoo Finance. Data may be delayed by approximately 15 minutes. Superinvestor Form 13F positions reflect historical regulatory filings reported with up to a 45-day lag. We do not warrant the absolute real-time accuracy, timeliness, or completeness of third-party market data.

8. Limitation of Liability & Warranty Disclaimer

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MOATPICKS.IO IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. UNDER NO CIRCUMSTANCES SHALL MOATPICKS AI, ITS DIRECTORS, EMPLOYEES, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION TRADING LOSSES, LOST PROFITS, OR CAPITAL DRAWDOWN ARISING FROM YOUR USE OF OR INABILITY TO USE THE PLATFORM.

9. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the European Union and Spain, without regard to conflict of law provisions. Any dispute arising out of or related to these Terms shall be subject to the exclusive jurisdiction of the competent courts.
